MINUTES
Mayor Kathy Mulcahy called the meeting to order at 7:30 pm.

PZ/ABR Discussion: Joint motion to approve was made by Lewis; seconded by Terlep.

#2 REPORT AND RECOMMENDATION (Ordinance 2010-8)
An Ordinance granting a private garage square footage variance and a front yard setback
variance to Carl Hagerling for his property located at 4939 East Woodcrest Drive.
PZ Discussion: Mr. Carl Hagerling was sworn in by the Assistant Director of Law and the Commission
received testimony from Mr. Hagerling. The practical difficulty or “hardship” standard of
review for the granting of a variance, set forth in Section 1142.06(b) of the Codified
Ordinances, was discussed. The Commission also reviewed, discussed, and applied
the practical difficulty or hardship standards set forth in Section 1142.06(b)(1)-(8).
Commission members noted that the requested private garage square footage variance
was substantial and that future use of the garage was a concern. The size of the garage
and its impact on adjoining properties was also discussed. Commission members
concluded that Mr. Hagerling has not encountered a practical difficulty or an unnecessary
hardship in the use of the property. Motion to recommend the requested variances were
defeated. Motion was made by Braverman; seconded by Lewis.

#3 FENCE - Dr. Ben Hornstein, Owner

PZ/ABR Discussion: A fence was being installed around his vegetable garden without obtaining a permit.
The Building Commissioner stopped the work. Motion to approve was made by Kline;
seconded by Lewis.

#4 PRESENTATION - Service Department Site Selection, By Mayor Kathy Mulcahy
PZ/ABR Discussion: Mayor Mulcahy gave a brief summary of the Service Department site selection history.
Mayor Mulcahy also talked about the property available (property size, cost, opportunities available
using some of the existing structures) adjacent to Village Hall. Motion to recommend using the
property adjacent to Village Hall (St. Margaret of Hungary property) as the best site selection for
the new Service Department facility was made by Mulcahy; seconded by Terlep.

#5 BUILDING COMMISSIONER’S REPORT
· Tom Shields continues to drive around the Village looking for property violations.
· Lou performed an inspection at the Service Department (4160 Lander Rd).
#6 ANY OTHER TOPIC FOR DISCUSSION
· Wasabi Steakhouse needs to balance their ventilation system.
· David Hartt, memo regarding fence regulations in the Landerwood Glen subdivision.
· Herb Braverman updated the members on the Community Garden.
· The Orangewood Subdivision will reconstitute the Architect Review Board for projects within their development.
Motion to approve the minutes of the April 6, 2010 meeting was made by Kline; seconded by Terlep.
