Mayor Kathy Mulcahy called the meeting to order at 7:30 pm

PZ/ABR Discussion:  Joint motion to approve the plans, excluding the ‘optional shed and sport court’, subject to the 		following:
			1.  The Village Engineer recommends using an eight inch (8”) storm drain pipe although 				     the owner/contractor may choose to use a six inch (6”) pipe, and
	 	 	2.  Add additional cleanouts 
		was made by Hitt; seconded by Centanni.

#3	REPORT AND RECOMMENDATION TO COUNCIL:  (ORDINANCE 2007-32)
AN ORDINANCE GRANTING A REAR YARD VARIANCE TO H&M LANDSCAPING TO ALLOW A DECK TO BE ADDED TO THE RESIDENCE AT 325 CAPITOL HILL DRIVE.

PZ Discussion:  Discussion was had about alternative options other than a deck.  Suggestions included ‘flip-flopping’ the deck or installing a patio.  The contractor will speak to the owner on these different options.

PZ/ABR Discussion:  Joint motion to approve subject to the following:
			1.  A final grading approval from the Village Engineer,
			2.  Orange Village Fire Department to approve the ‘standpipe’,
			3.  All punch items on the Engineer’s letter to be completed and/or approved, and
			4.  Permit will not be issued until all monies owed are paid in full
		was made by Hitt; seconded by Shanes.

Carol Palansky noted:
1.  In places where grass will not be placed, a 4-6 inch mix of leaf humus and topsoil will be placed for the
     plantings, and
2.  Erosion matting will be placed on all the slopes for erosion control.

#8	U-3a REZONING DISCUSSION				- Weintraub Property/Harvard Rd.
								- David Hartt, Village Planner

David Hartt passed out a ‘marked-up’ handout of the U-3A/Residential Mixed Use District. The amendments to the district were discussed.   Dave will also make the same presentation to Council on October 3rd.   

#9	BUILDING COMMISSIONER’S REPORT

·	The construction at the Temple Emanu El is moving along.  The installation of the sanitary sewer was completed by Neptune Plumbing.  They will start the storm sewer soon.  Ullman Electric will start the electrical portion soon.  
·	The Building Department is looking into the demolition of the house at 27400 Harvard Rd.   

#10	ANY OTHER TOPIC FOR DISCUSSION

·	Alex Savitz of Stelex Equities requested the Building Department to carbon copy (cc:) Stelex Equities on the letter to S. Weintraub regarding the demolition of the house. 
·	Jordan Berns stated Stelex Equities has given a $30,000 deposit, which shows ‘ this substantial sum of money shows this company will take all steps necessary to see that this project goes through to fruition’.

·	Carmen Centanni mentioned the car and plow had disappeared from the house on Brainard Rd.
·	Carmen Centanni asked why the flags were on the 7-acre parcel on Miles Rd.




Motion to approve the minutes of the September 4, 2007 meeting with the following corrections was made by Centanni, seconded by Hitt.

Corrections: 
	1.  On the first page heading, change ‘Architect’ to ‘Engineer’ where it reads ‘Others Present’ for Brian
	     Mader’s position.
	2.  In the corrections for the August 21, 2007 minutes, on the third line, it should read August 7th, not
	     August 27th.
