ORANGE VILLAGE COUNCIL
REGULAR MEETING
AUGUST 9, 2006








Mark Bram, President of Council, called the meeting to order at 6:15 pm for the purpose of 
conducting interviews for the Clerk of Council position.

Motion to adjourn to executive session for the reason stated above was made by Kluter; 
seconded by Soroky.

4.    Motion to confirm the appointment of William Buettner as a firefighter was made by Soroky; 
seconded by Kluter.

5.    Motion to confirm the appointment of Timothy Byrne as a firefighter was made by Kluter;

6.    Motion to confirm the appointment of Jessica Conant as a firefighter was made by Kluter;

7.    Motion to accept the minutes of the July 12, 2006 regular meeting as amended was made by 
Soroky; seconded by Kluter.  Correction:  #9 – Braverman abstained.

8.    Motion to accept the minutes of the August 2, 2006 special meeting as amended was made by 
Brown; seconded by Soroky.  Corrections:  “work session” at top of page redundant – remove, #5F 
– remove “of Ohio” after Orange Village Residential Code, and #11 – remove “an executive session to…” 
typed twice.

9.    Motion to accept the June 2006 Treasurer’s Report was made by Brown; seconded by Soroky.

11.  Motion to approve the payment of bills in the amount of $366,665.18 and the additional expenses of $25,877.60 
was made by Brown; seconded by Soroky.

A.	ORDINANCE NO. 2006-17
An ordinance granting an area variance for an attached garage to Berns Custom Homes, Inc. at sublot 6 of the 
Waterford Court Subdivision.  3rd reading.
*Planning & Zoning Commission recommends council to approve Ordinance No. 2006-17.

Mr. Berns submitted a letter requesting to withdraw the variance request for sublot 6 Waterford Ct.
Motion to approve Ordinance No. 2006-17 was made by Centanni; seconded by Brown.

B.	ORDINANCE NO. 2006-18
An ordinance granting an area variance for an attached garage to Justin Berns at sublot 7 of the Waterford Court 
Subdivision.  3rd reading.
*Planning & Zoning Commission recommends council to approve Ordinance No. 2006-18.
Mr. Berns submitted a letter requesting to withdraw the variance request for sublot 7 Waterford Ct.

Motion to approve Ordinance No. 2006-18 was made by Centanni; seconded by Brown.

C.	ORDINANCE NO. 2006-19
An ordinance authorizing the modification or amendment of deed restrictions imposed on certain property by 
P&Y Development Co. Limited Partnership in favor of Orange Village.  3rd reading.

Motion to amend the ordinance by removing the sentence (p.3) the distances between residences which front 
on private roads are staggered between fifteen feet (15’) and twenty feet (20’) was made by Centanni; seconded 
by Soroky.  There was no objection from Mr. Kertesz.

	An ordinance granting a yard variance to Stanley Friedlander and Cheryl Karner, for their property 
at 38 Orchard Circle.  3rd reading.
*Planning & Zoning Commission recommends council to approve Ordinance No. 2006-21.

Motion to adopt the Conclusion of Fact was made by Kluter; seconded by Soroky.

E.	ORDINANCE NO. 2006-30
An ordinance accepting the pledge of the donation of, and authorizing the Mayor to accept for village ownership, 
approximately seven acres of real property with frontage on Miles Road.  3rd reading.

Motion to approve Ordinance No. 2006-30 was made by Braverman; seconded by Brown.

F.	ORDINANCE NO. 2006-25
An ordinance amending Chapter 1303 of the Orange Village Codified Ordinances to enact the Orange Village 
Residential Code for one-, two-, and three-family dwellings, and repealing certain ordinances. 
2nd reading, as amended.

G.	ORDINANCE NO. 2006-34
An ordinance amending Chapter 1331 of the Codified Ordinances of Orange Village, to modify regulations 
related to property maintenance, and repealing conflicting ordinances.  2nd reading.


14.   New Business: Introduction and consideration of:
A.	ORDINANCE NO. 2006-35
An ordinance providing compensation and benefits for certain village employees, and revising certain provisions 
which establish the appointment and composition of certain village departments.  1st reading.
Referred to the Finance Committee.

B.	ORDINANCE NO. 2006-36
An ordinance repealing section 121.01 of Chapter 121, Mayor, of the Orange Village Codified Ordinances to 
eliminate reimbursement to the Mayor for Ohio Bell Telephone Company service.  1st reading.

Motion to suspend the rules was made by Braverman; seconded by Centanni.

An ordinance granting a front yard variance to Erin and Robert A. Herbruck, III, at 31700 Woodcrest Drive.  1st reading.

D.	ORDINANCE NO. 2006-38
An ordinance establishing an equitable tap-in fee for the property of the Barkley Pet Hotel and Day Spa at 
27349 Miles Road in Orange Village and declaring an emergency.  1st reading.

Motion to suspend the rules was made by Centanni; seconded by Soroky.

for the resurfacing of the village hall parking lot was made by Brown; seconded by Centanni.
