ORANGE VILLAGE COUNCIL
REGULAR MEETING
OCTOBER 11, 2006




1.	Mark Bram, President of Council, called the meeting to order at 8:01pm.

2.	Pledge of Allegiance

3.	Roll call
	Members present: Centanni, Perry, Brown, Braverman (arrived 8:12pm), Soroky, Kluter, Bram
	Other present:	Mayor Kathy Mulcahy		Brian Mader, Engineer
			Stephen Byron, Law Director		Christopher Kostura, Police Chief
			Roger Delman, Treasurer 

4.	Council President Bram amended the agenda to allow Mr. Joel Ratner to speak on Cuyahoga 
              County ballot 	Issue 18 to support the arts and culture.

5. 	Motion to accept the minutes of the August 9, 2006 regular meeting as amended was made by Centanni; 	
	seconded by Soroky.
	Ayes:	Centanni, Perry, Brown, Soroky, Kluter, Bram
	Nays:	None
              Minutes amended to correct total cost of the Village Hall parking lot reconstruction as $198,133.

6.	Motion to accept the minutes of the September 13, 2006 regular meeting as amended was made 
	by Soroky; 	seconded by Centanni.

	Nays:	None
	Abstain:	Perry, Brown
	Minutes amended to correct the date of the Planning & Zoning meeting from August 9th to August 15th.

7.	Motion to accept the minutes of the October 4, 2006 special meeting was made by Brown; 
              seconded by Soroky.

	Braverman arrived at 8:12pm.
	
8.	Motion to accept the August 2006 Treasurer's Report was made by Centanni; seconded Brown.

	Nays:	None

9.	Motion to accept the September 2006 Tax Administrator's Report was made by Centanni; 
	seconded by Soroky.

	Nays:	None

10.	Motion to approve the payment of bills in the amount of $234,580.81 and the additional expenses 
	of $75,853.52 	was made by Brown, seconded by Soroky.

12.	Old Business: Introduction and reconsideration of:
	A. ORDINANCE NO. 2006-39
	An ordinance providing compensation for the office of the Village Architect, and declaring an emergency.  
	3rd reading.
		Motion to adopt Ordinance No. 2006-39 was made by Centanni; seconded by Brown

		Nays:	None

13.	New Business: Introduction and consideration of:
	A. ORDINANCE NO. 2006-35
	An ordinance providing compensation and benefits for certain village employees, and revising certain 
	provisions which establish the appointment and composition of certain village departments.  
	1st reading, as amended.
	Finance Committee recommends council to approve.




B. ORDINANCE NO. 2006-40
	An ordinance establishing an equitable sanitary sewer connection fee for the property of the Temple 
	Emanu El at 4545 Brainard Road in Orange Village and authorizing the use of the Emery Road and 
	Brainard Road rights of way for a sanitary sewer force main to connect to the gravity main on Brainard 
	Road and declaring an emergency.  1st reading.
	Referred to Planning & Zoning Commission.

C. ORDINANCE NO. 2006-41
	An ordinance amending Chapter 721 of the Codified Ordinances of Orange Village to regulate solicitors 
	and uninvited visitors, and repealing certain ordinances.  1st reading.
	Law Director asked the Safety Committee (Kluter-chair) to  meet prior to the November1, 2006 work 
	session to review ordinance language. 

D. ORDINANCE NO. 2006-43
	An ordinance amending certain chapters of the Zoning Code of Orange Village to permit the placement
	 of newspaper boxes as accessory uses adjacent to buildings in certain zoning districts which are 
	established as certain principal uses, and repealing certain ordinances.  1st reading.
	Referred to Planning & Zoning Commission.

E. ORDINANCE NO.  2006-44
	An ordinance appointing the Law Director and the Law Department of Orange Village, providing 	
	compensation, and repealing certain ordinances.  1st reading.

F. ORDINANCE NO.  2006-45
	An ordinance appointing and confirming the appointment of Stephen Hovancsek & Associates, Inc. as 	
	Orange Village Engineer and repealing certain ordinances.  1st reading.
	
G. ORDINANCE NO.  2006-46
	An ordinance amending Section 1148.09 of the Codified Ordinances of Orange Village, to modify 
	regulations related to dwelling unit area and lot coverage and repealing certain ordinances.  1st reading.
	Referred to Planning & Zoning Commission.

H.	ORDINANCE NO. 2006-47
	An ordinance granting side yard variances to Chris and Vickie Nassif at 3939 Beechmont Circle. 
	1st reading.
Referred to Planning & Zoning Commission.

I.	ORDINANCE NO. 2006-48
	An ordinance establishing the compensation of the Assistant Treasurer of Orange Village and 
	declaring an emergency.  1st reading.
	Ordinance to be amended to reflect employee contribution.

J.	RESOLUTION NO. 2006-6
	A resolution urging the support of Issue 19, Cuyahoga County Health and Human Services Replacement 
	and Reduction Levy.
	Motion to approve Resolution 2006-6 was made by Braverman, seconded by Kluter.
	Ayes:	Centanni, Perry, Brown, Braverman, Soroky, Kluter, Bram
		Nays:	None

K.	RESOLUTION NO.  2006-7
	A resolution accepting the amounts and rates as determined by the Budget Commission and authorizing
	 the necessary tax levies and certifying them to the County Auditor. 
	Motion to approve Resolution 2006-7 was made by Brown; seconded by Kluter
	Ayes:	Centanni, Perry, Brown, Braverman, Soroky, Kluter, Bram		
	Nays:	None

M.  RESOLUTION NO. 2006-8
	A resolution supporting the regional approach to economic development proposed by the City of Cleveland.
	Motion to approve Resolution 2006-8 was made by Brown; seconded by Perry.

15.	Report of Council President
	· Orange Community News, Autumn Edition is at the printer to be mailed shortly.
	· Village Master Plan, which has been in committee (Long Range Planning - Soroky, Chair) 
	will be discussed at the November work session. 
			
16.	Report of Mayor
	· Roger Delman, Treasurer to investigate options for short term financing of Emery Road water lines.
	· Orange Village received an award from AAA in recognition of a 48 year record of fatality-free 
	pedestrian safety.

17.	Report of Council Members and Committees
	· Perry to serve as a member of the Tinker's Creek Watershed Partners.
	· Kluter confirmed Tuesday, October 24th as the next Safety Committee meeting at 6:00pm
	· Soroky confirmed Wednesday, October 25th as the next Long Range Planning meeting at 7:00pm

18.	Motion to adjourn to executive session for the purpose of discussing land acquisition and pending 
	litigation was made by Brown, seconded by Kluter.

	Nays:	None

	Adjourned to executive session at 9:27pm.

19.	ORDINANCE NO. 2006-49
	An ordinance engaging the services of Michael E. Murman, Attorney at Law, as Special Counsel for 
	an administrative appeal to the Cuyahoga County Court of Common Pleas, and declaring an emergency.
	1st reading.
	Motion to suspend the rules was made by Kluter; seconded by Perry.
	Ayes:	Centanni, Perry, Brown, Braverman, Soroky, Kluter and Bram
	Nays:	None

	Motion to adopt Ordinance No. 2006-49 was made by Kluter; seconded by Perry.
	Ayes:	Centanni, Perry, Brown, Braverman, Soroky, Kluter and Bram
	Nays:	None

20.	Motion to adjourn to a reconvened meeting on October 18, 2006 at 6:30pm for the purpose of
	discussing a new 	Service facility was made by Centanni; seconded by Brown.

	Nays:	None
