Mayor Kathy Mulcahy called the meeting to order at 7:30 pm.

PZ/ABR Discussion:
The Commission reviewed the plans and discussed the variance approved by Council.
It was noted that Mr. Hagerling, in his variance application, voluntarily offered to execute
a deed restriction and that such offer was included in the Conclusions of Fact adopted
by Council. The Commission, in reviewing the original project in 2010, expressed concerns
with the size of the garage and use of the property. The Assistant Law Director indicated
that the deed restriction prepared last year was revised to remove the references to the
front yard setback variance that is not part of the current project. The prepared
Declarations of Covenants and Restrictions, however, consistent with the document
previously prepared in 2010, will authorize the storage of a recreational vehicle owned by
the property owner or resident and will prohibit commercial uses in an effort to address
the concerns of the Commission.
The Commission also discussed Section 1160.03(b) of the Codified Ordinances,
permitting a one-story unenclosed porch in a U-1 District to extend more than twelve
feet in front of the building line, and its application to the project.
Mr. Hagerling presented the Commission with sample materials and a color board of
the various materials that will be used on the new home.
Joint motion to approve subject to the following:
1. On the entrance unenclosed porch, a “shelf” to be provided thereby creating
a gap/separation between grade and the bottom of the stone.
2. Satisfaction of both the Village Architect’s review letter dated September 1, 2011
and the Village Engineer’s review letter dated August 30, 2011

#5 DISCUSSION ONLY - (Sunoco) Gas Station
Proposed Signage, - 28021 Miles Rd.
Building Frame, - Nick Najjar, Owner & Representative
Pump & Pole Colors
Present: Nick Najjar
Mr. Najjar presented a brochure showing proposed signage, color and design as
it pertains to the building frame, pump and pole colors. Mr. Najjar received positive
feedback from the Board Members.
#6 BUILDING COMMISSIONER’S REPORT
· Red Lobster is working on renovations, both interior and exterior
· Massage Envy is ready to pick up their permit
· Lou is keeping an eye on the gas station at 28021 Miles Road, to make
sure they repair the concrete work before they open for business
· The fence at Landerwood Glen has been painted
#7 ARCHITECT’S REPORT
· Discussion was had on the submittal of recent plans. Some plans have
been inadequately drawn.
#8 ANY OTHER TOPIC FOR DISCUSSION
· Discussion also included which projects should be discussed at the
PZ/ABR meetings and potentially which projects can be reviewed by the
Architect and Building Department only. Perhaps the Board Members should
review #1325 Code on plans submittal.
Motion to approve the Minutes of the August 16, 2011 meeting was made by
Braverman; seconded by Hitt.
