1. Dan Brown, Council President, called the Work Session to order at 8:00 p.m.

4. Old Business: Discussion of Pending Legislation and Motions:
A. ORDINANCE 2008-17
An Ordinance authorizing the Mayor to enter into a non-drilling oil and gas lease
agreement with Bass Gas Incorporated and utilize a portion of a Village right of
way to obtain revenue for the benefit of the Village. 3rd Reading Referred to Planning
& Zoning. Approved 4-0 P & Z voted 4-1 to reconsider the July 15th vote at the
August 5th meeting. They then voted to table the issue 5-0. The Law Director
recommends that this Ordinance be defeated as the decision has already been
made by the ODNR to require mandatory pooling.
B. ORDINANCE 2008-20
An Ordinance amending certain sections of Chapter 1327 of the Codified Ordinances
of Orange Village to provide fees and deposits, and repealing certain ordinances. 2nd Reading
C. ORDINANCE 2008-22RESIDENT’S COMMENTS
Randy Kertesz - 43 Orchard Circle
– supports checking septic systems at point of sale and smoke detector
and carbon monoxide requirements.
David Paulus – 28300 Jackson Road
– need to address septic system testing in vacant dwellings
- need education of residents to enforce this
Phil Soroky – 28650 Orange Meadow
– 629 Registered septic systems in Village
- Issue Point of Sale Permit for compliance
- Complete point of sale inspections
Randy Kertesz – 43 Orchard Circle
- Reasonable escrow fees
- Address necessity of re-inspection for new dwellings
- Inspect mechanical systems at point of sale
(electrical, plumbing etc.)
D. ORDINANCE 2008-23
An Ordinance amending various sections of Chapter 1373, Smoke and Carbon
Monoxide Detectors, to require all owners of dwellings and dwelling units to install
and maintain Carbon Monoxide Detectors. 3rd Reading. Referred to Safety Committee –
They did not recommend passage in present form 4-3. Discussion ensued about
enforcement using education and Fire Department personnel.
E. RESOLUTION 2008-3
A Resolution supporting the Chagrin River Watershed Balanced Growth Plan in
cooperation with the Ohio Lake Erie Commission’s Balanced Growth Program.
Referred to P & Z. P & Z recommended passage of the resolution by Council.
5. New Business: Discussion of New Legislation and Motions:
- Adding to the agenda for 9/10/08 a request to declare a kennel as a surplus item.
- Coming to Council for the extension of water lines for Fire purposes so that we have
access to water within 2000 feet of a home. – Need a resolution to apply for Issue I
funds for 50 percent grant money. Total cost is approximately $750,000 – seeking
half in grant money.
