DECEMBER 7, 2005


MINUTES



1. Lisa Perry, Council President, called the meeting to order at 8:00 pm.

4. Roll Call:
Members present:	Bram, Weisblatt, Brown, Braverman, Soroky, Kluter and Perry

5.    Joel Ratner, State Representative candidate

6.    Motion to confirm the appointment of Lt. Robert Wilson as Assistant Fire Chief was 
made by Bram; seconded by Kluter.

Abstain:	Weisblatt

7.    Motion to confirm the appointment of Daniel Fritz as Lieutenant in the Fire Department 
was made by Bram; seconded by Braverman.
Ayes:	Bram, Brown, Braverman, Soroky, Kluter and Perry
Abstain:	Weisblatt

8.    Motion to confirm the appointments of new firefighters Nick Baucco and Richard Koblin 
was made by Weisblatt; seconded by Bram.
Ayes:	Bram, Weisblatt, Brown, Braverman, Soroky, Kluter and Perry

9.    Councilwoman Kluter presented the memorial plaque to the Fritz family.

11.  New Business: Introduction and consideration of:
A. RESOLUTION NO. 2005-14
A resolution accepting the amounts and rates as determined by the Budget Commission 
and authorizing the necessary tax levies and certifying them to the County Auditor.

Motion to approve Resolution No. 2005-14 was made by Weisblatt; seconded by Brown.

B. ORDINANCE NO. 2005-35
An ordinance appointing the Law Director and the Law Department of Orange Village, 
providing compensation, and repealing certain ordinances.  1st reading.

C. ORDINANCE NO. 2005-36
An ordinance approving and confirming the appointment of Stephen Hovancsek & 
Associates, Inc. as Orange Village Engineer and repealing certain ordinances.  1st reading.

Work Session
13. Old Business: Introduction and reconsideration of:
A. ORDINANCE NO. 2005-17
An ordinance authorizing the Mayor to enter into a lease agreement with J&J Energy, LLC, 
to drill for oil and gas on Orange Village property.  2nd reading, as amended
Planning & Zoning Commission recommends Council to approve 11-15-05.
Jeff Berlin and Jeff Baker, J & J Energy, will be present at the Dec. 14th meeting to discuss the lease.
Councilman Brown informed council that he does have a business relationship with 
Jeff Berlin and will need to abstain from voting later on.

B. ORDINANCE NO 2005-31
An ordinance granting a rear yard variance to Mr. And Mrs. John Haselow of 3869 Wild Cherry Oval.
2nd reading.
Referred to Planning & Zoning Commission - no action taken 11-15-05.  Not ready for advancement.

C. ORDINANCE NO. 2005-32
An ordinance amending Chapter 1377 of the Code of Ordinances of Orange Village to modify 
Storm Water Management regulations.  2nd reading.
Kyle Dreyfuss-Wells from Chagrin River Watershed Partners to speak on both ordinances 
(2005-32 and 2005-33) at the January 11th meeting.

D. ORDINANCE NO. 2005-33
An ordinance enacting Chapter 1378 of the Code of Ordinances of Orange Village to modify 
erosion regulations.  2nd reading.

E. ORDINANCE NO. 2005-34
An ordinance amending Chapter 505 of the Codified Ordinances of the village to prohibit the 
outdoor feeding of animals.  2nd reading.
Referred to the Long Range Planning committee to determine if the ordinance can be enforced, 
if it is in conflict with the nuisance animal ordinance, how would this apply to "Have a Heart" traps, etc.  
Suggested that Damon Greer of the ODNR, Division of Wildlife, be contacted for input.

14.  Reconvened the special meeting at 9:32 pm.

15.  Motion to adjourn into executive session for the purpose of discussing the appointment and 
compensation of public employees and prospective litigation was made by Weisblatt; seconded 
by Kluter.  Councilman-elect Centanni was invited to participate.
