Snow Removal Regulations for Driveways and Sidewalks
Orange Village has passed regulations for snow removal from driveways and sidewalks. These laws are to keep debris and snow off the roadways and too ensure safe passage for motorists and pedestrians.
725.01 PERMIT REQUIRED; APPLICATION; FEE.
No person shall engage in the business of snow plowing in the Village without first obtaining a written permit therefor from the Village. An application for such permit shall inform the Village of the make, model and serial number of each vehicle to be used as a snowplow and the identity of each person who will operate such vehicle. No permit shall be issued until an annual license fee has been paid in the amount of five dollars ($25.00) per vehicle. (Ord. 2002-30 was passed on 9-11-2002)
725.02 PLACING SNOW OR DEBRIS NEAR FIRE HYDRANTS.
No person shall transport, snow plow or otherwise place snow, ice or other debris within seven feet of a fire hydrant to conceal or limit access to such hydrant. (Ord. 1986-18. Passed 2-12-86
752.99 PENALTY.
Whoever violates any provision of section 725.01 is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days or both for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. (Ord.1979-56 Passed 12-12-79)
Whoever violates Section 725.02 is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000.00) or imprisoned not more than six months or both for each offense. (Ord. 1986-18. Passed 2-12-86.)
1979-56 MUD, SNOW AND DEBRIS ON STREETS AND PUBLIC GROUNDS
No person shall throw, place, deposit, drop, push or leave upon any public street, highway, pavement, sidewalk or public ground, fire hydrants or city trees any dirt, mud, gravel, or snow or anything or article of any nature likely to or tending to construct or create a nuisance or hazard to any person or vehicle traveling upon or using such street, highway, pavement, or sidewalk which might damage, deface or obscure such street, highway, pavement, sidewalk, fire hydrants or city trees. Penalty for above is a first-degree misdemeanor under the Orange Village Ordinances and punishable up to $1,000.00 fine and imprisonment of up to a year in jail.
521.06 DUTY TO KEEP SIDEWALKS IN REPAIR AND CLEAN
No owner or occupant of abutting lands shall fail to keep the sidewalks, curbs or gutters in repair and free from snow, ice or any nuisance. (ORC 723.011)
Whoever violates this section is guilty of a misdemeanor of the fourth degree.
DO'S AND DON'TS OF SNOW REMOVAL
Do not push snow across street. You maybe placing the snow in someone else's yard. What falls on to a drive or sidewalk stays with that yard. When you push across a street you assume liability should a problem arise from your actions.
Do not push snow to street end of drive and block visibility of on coming traffic or blocking a sidewalk. Do not push snow against mailboxes. This can cause an accident and possible damage to the mailbox either directly or indirectly. Also when the street plows come by they may push snow back into the end of the driveway.
Do find a place where you can push the snow at the other end of the drive or part way down the drive.
