Mayor Mulcahy called the meeting to order at 7:30 pm.

PZ/ABR Discussion:      Mr. Simon advised the Commission that the fence will be constructed 
on property owned by the Josephs’.  The proponents, in order to address concerns regarding 
the property line, will have a new survey done.  The proponents agreed to call the Building 
Commissioner with the date that the survey will be conducted in order that the Building Commission 
may notify  the Jaryga’s when this is scheduled should they want to be present.  The gate in the rear
 of the property will not be included.  The Building Department will review the new drawing.  
Motion to approve was made by Lazar; seconded by Kline.

#7	REPORT & RECOMMENDATION, (Ordinance  2011-12 As Amended) 	

An Ordinance granting certain variances for a private garage to Carl Hagerling for his 
property located at 4939 Woodcrest Drive.

Present:  Carl Hagerling

Mr. Carl Hagerling was sworn in by the Assistant Director of Law.  The Commission discussed 
the practical difficulty or “hardship” standard of review for the granting of a variance, set forth in 
Section 1142.06(b) of the Codified Ordinances, and Mr. Hagerling reminded the Commission 
that the variance was requested in order to provide garage parking for a recreational vehicle.  
The Commission noted that this variance request is substantially similar to Mr. Hagerling’s 
variance request that was reviewed by the Commission and approved by Village Council in 
July of 2010.  It was noted that this variance request is for two variances and that the third 
variance for a front yard setback that was approved in 2010 is no longer needed as the current 
plans provide for the construction of a new home and not the remodel of an existing home.

Mr. Hagerling’s variance application indicated that he is “receptive to accepting a deed restriction 
on the property” to prevent possible non-residential usage of the garage.  The Commission, noting 
previous discussions on Mr. Hagerling’s current variance request and 2010 variance request, 
recommends the execution of a Declarations of Covenants and Restrictions as a condition of 
variance approval.



#7	REPORT & RECOMMENDATION, (Ordinance  2011-12 As Amended) Continued:

The Commission also noted that, if the variance is approved by Village Council, the project 
would appear before the Commission and the Architectural Board of Review for review.

#8	BUILDING COMMISSIONER’S REPORT

·	Lou spoke with the Landerwood Glen’s property manager, Howard Danzinger 
	in regards to when will the newly installed fence along Lander Road be painted.  
	Howard stated it would be painted in the next week or two. 

#9	ARCHITECT REPORT 

·	Ron Kluchin will work on a ‘criteria list’ for fence submittals.  He will also review 
	this with the Building Commissioner.
	Ron has been busy with meetings and pricing in going forward with the amphitheater 
	and future Service Department facility.


#10  	ANY OTHER TOPIC FOR DISCUSSION

	It was requested that the Assistant Law Director work with the Architect and Building 
	Commissioner to draft legislation requiring vinyl coating on wire fences for consideration 
	and review by the Commission.


Motion to approve the Minutes of the July 5, 2011 meeting was made by Braverman; seconded by 
Hitt with the following correction:

On project #2, on bullet #2, remove the word “and”.
