MINUTES





Mayor Mulcahy called the meeting to order at 7:30 pm.

Members Present:	Anthony Lazar, Jud Kline, Herb Braverman, Brian Hitt, Mayor Kathy Mulcahy

Members Absent:	Scott Lewis

#1	FENCE				- Deborah & Carey Arnold, Owner

PZ/ABR Discussion:  Joint motion to approve subject to having the option of adding a gate 
to the rear wooden fence and not have to come back to a PZ/ABR meeting and instead, 
have approval by Lou Hovancsek and Ron Kluchin was made by Hitt; seconded by Kline.

#2        LAKES OF ORANGE TIME EXTENSION          - Randy Kertesz, Representative

Present:  Randy Kertesz

The Assistant Law Director, Rebecca Schaltenbrand, advised the Commission that
Ordinance No. 2009-06, authorizing the Commission to grant a time extension to the 
Lakes of Orange, does not limit the time frame of any extension and does not limit the 
number of extensions that may be granted.  

The Commission determined that the following are good cause reasons supporting a 
time extension of twenty-four (24) months:

·	Current economic climate; 
·	Good faith effort made by Mr. Kertesz to move forward, despite the economic 
	conditions; 
·	No detriment to the Village; 
·	Plans have not  changed; and 
·	Water-line will be constructed to service the area. 

PZ Discussion:  Motion to grant a twenty-four (24) month extension of time for the Lakes of 
Orange, LLC to complete all subdivision improvements was made by Mayor Mulcahy; 
seconded by Hitt.

#3	DISCUSSION ONLY		- Conrad’s Tire
					- John Turk, Representative
Present:	John Turk, President, Conrad’s Tire
		Dominic Umec, General Manager Retail Division, Conrad’s Tire

·	Discussion was had about Conrad’s Tire possibly opening a store in Orange 
	Village on Chagrin Blvd.
·	Possible locations include the Village Auto Wash location (U-4 District) or the 
	empty space at the (old) Saturn location (U-7 District).  
·	The Planning & Zoning Commission discussed the uses in the area and the 
	relationship of the proposed Conrad’s Tire to existing uses.
·	The assistant law director, citing Section 1154.02 of the Codified Ordinances, 
	determined that an auto repair shop that is not a lawful nonconforming use 
	existing as of January 1, 1994 is not a ‘permitted use’ in the U-4 Zoning Code.  
	Therefore, the proposed use in the U-4 would need to be found to be a similar use.  

#4	DISCUSSION ONLY		- Internet Café

Mr. & Mrs. Jordan Henderson are interested in opening an internet café in Orange Village, 
but currently they cannot find a large enough space with adequate parking.

#5	DISCUSSION ONLY		- Charter Amendment for Architect Position

·	Mayor Mulcahy requested that Assistant Law Director Rebecca Schaltenbrand 
	draft an ordinance submitting a charter amendment to the residents authorizing 
	a landscape architect to serve on the Architectural Board of Review.   
·	Rebecca Schaltenbrand mentioned an option of having “architect advisors” 
	serve as non-voting members of the Architectural Board of Review.  
	The Board, after discussing the option, rejected the idea.

#6	BUILDING COMMISSIONER’S REPORT

·	There are 8 letters going out to residents informing them that their house needs 
	painting, gutters, other misc. repairs, etc.
·	LJI Collision Center should be opening in about 2 weeks. 
·	FedEx started interior alterations without a permit, so Lou issued a ‘stop work order’, 
	until they submit plans and obtain a permit.
·	Lakeshore Learning Center work slowed up as they are having an issue with their 
	cabinets and their opening will be delayed by 30 days.
·	The Orange Plaza owners are thinking about moving Papa Santis tenant to a vacant 
	space in the building, thereby enabling the combining of two empty spaces into 
	one larger space to lease. 

#7	ANY OTHER TOPIC FOR DISCUSSION

	Mayor Mulcahy reported the following:
·	There has been recent interest in the Weintraub property.
·	Council has approved the design process for the property next door.
·	Waiting for a final vote on the amendment to the architect’s contract for the amphitheatre; and 
·	Kick off meeting on May 2nd.


Motion to approve the Minutes of the March 1, 2011 meeting was made by Kline; seconded by Braverman.
