PUBLIC HEARING ORDINANCE NO. 2006-17 An ordinance granting an area variance for an attached garage to Berns Custom Homes, Inc. at sublot 6 of the Waterford Court Subdivision. No comments. PUBLIC HEARING ORDINANCE NO. 2006-18 An ordinance granting an area variance for an attached garage to Justin Berns at sublot 7 of the Waterford Court Subdivision. No comments. PUBLIC HEARING ORDINANCE NO. 2006-19 An ordinance authorizing the modification or amendment of deed restrictions imposed on certain property by P & Y Development Co. David Hartt: presentation of Master Plan 5. Motion to accept the minutes of the April 5, 2006 regular meeting as amended was made by Brown; seconded by Perry. New Business, J: wrong motion listed – it was for the breathing air compressor and self-contained breathing apparatus. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None 6. Motion to accept the minutes of the May 3, 2006 special meeting as amended was made by Centanni; seconded by Brown. Corrections: Change “regular meeting” to “special meeting” in the title and include ordinances 2006-25 and 2006-26 under new business (1st reading). Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None 7. Motion to accept the March 2006 Treasurer’s Report was made by Brown; seconded by Perry. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None 8. Motion to accept the April Tax Administrator’s Report was made by Perry; seconded by Centanni. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None 9. Motion to approve the payment of bills in the amount of $152,818.72 and the additional expenses of $76,474.72 was made by Perry; seconded by Soroky. ORDINANCE NO. 2006-14 An ordinance to levy and collect a special assessment for the costs of abating a nuisance by removing unlicensed vehicles and other personal property from the property at 4819 East Fairview Drive, permanent parcel no. 901-40-008. 3rd reading. Motion to approve Ordinance No. 2006-14 was made by Perry; seconded by Brown. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None B. ORDINANCE NO. 2006-15 An ordinance authorizing the Mayor to enter into a contract with Greg Miller Animal Control Service for the provision of animal warden services within Orange Village and declaring an emergency. 3rd reading. Motion to approve Ordinance No. 2006-15 was made by Perry; seconded by Centanni. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None C. ORDINANCE NO. 2006-16 An ordinance approving and confirming the appointment of John Marrelli, Jr. as Alternate Chief Building Officer-Class I for the Building Department of Orange Village. 3rd reading. ORDINANCE NO. 2006-19 An ordinance authorizing the modification or amendment of deed restrictions imposed on certain property by P & Y Development Co. Limited Partnership in favor of Orange Village. 2nd reading. *Planning & Zoning Commission recommends council to approve Ordinance No. 2006-19. *Randy Kertesz made a presentation of the plan. Discussed the memo from DB Hartt dated 5-8-06. G. ORDINANCE NO. 2006-20 An ordinance amending certain sections of the Codified ordinances of Orange Village to alter development standards and procedures in the S-1 Special Residential District, incorporating certain procedural changes in Chapter 1143, Development Plan Review, and repealing certain ordinances. 3rd reading, as amended. *Planning & Zoning Commission recommends council to approve Ordinance No. 2006-20. Motion to approve Ordinance No. 2006-20 was made by Centanni; seconded by Brown. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None H. ORDINANCE NO. 2006-21 An ordinance granting a yard variance to Stanley Friedlander and Cheryl Karner, for their property at 38 Orchard Circle. 2nd reading. *Referred to the Planning & Zoning Commission. *Schedule a public hearing on June 14, 2006 at 8:00 pm. I. ORDINANCE NO. 2006-22 An ordinance authorizing the Mayor to accept for village ownership a frame dwelling located on approximately .0493 of an acre of land at 28600 Jackson Road in Orange Village, and declaring an emergency. 2nd reading. Motion to suspend the rules was made by Perry; seconded by Soroky. Ayes: Perry, Soroky, Centanni, Braverman, Brown, Kluter and Bram No: None Motion to approve Ordinance No. 2006-22 was made by Perry; seconded by Kluter. ORDINANCE NO. 2006-23 An ordinance authorizing Orange Village, Ohio to become a member of, adopting the Code of Regulations of, and directing the Mayor to enter into the Membership Agreement, the Master Services and Consulting Agreement, and the Master Products Agreement with, the Northeast Ohio Sourcing Office. 2nd reading. K. ORDINANCE NO. 2006-24 An ordinance approving and adopting the Orange Village Master Plan, dated April 24, 2006. 2nd reading. *Referred to the Planning & Zoning Commission. L. ORDINANCE NO. 2006-25 An ordinance amending certain sections of Chapter 1303 of the Orange Village codified Ordinances to adopt the Residential Code of Ohio for one-, two-, and three-family dwellings, authorizing a request to the Ohio Board of Building Standards to certify Orange Village for enforcement of the Residential Code of Ohio to exercise enforcement authority and accept and approve plans and specifications and make inspections, and repealing certain ordinances. 2nd reading. M. ORDINANCE NO. 2006-26 An ordinance amending Chapter 125 of the Codified Ordinances of Orange Village to create the position of Finance Administrator and to permit the Finance Administrator to sign checks, and establishing the pay range of the Finance Administrator. 2nd reading. 12. New Business: Introduction and consideration of: A. ORDINANCE NO. 2006-27 An ordinance levying special assessments for the improvement of Orange Place in Orange Village from Chagrin Boulevard southerly approximately 1,750 feet by repaving, widening and installing sidewalks, curbs, landscaping and streetscaping, together with all necessary appurtenances, in accordance with Resolution No. 2003-3, adopted April 9, 2003, and declaring an emergency. 1st reading. B. ORDINANCE NO. 2006-28 An ordinance levying special assessments for the improvement of the eastern side of Orange Place from a point approximately 1,750 feet south of Chagrin Boulevard southerly approximately 700 feet by installing sidewalks, landscaping and streetscaping, in accordance with Resolution No. 2003-4, adopted April 9, 2004, and declaring an emergency. 1st reading. C. ORDINANCE NO. 2006-29 An ordinance amending subsection (a) of section 1148.02 of the Codified Ordinances of Orange Village to modify regulations related to attached garages and to repeal conflicting ordinances. 1st reading. *Referred to Planning & Zoning Commission. 13.
